ALL DOGS ARE PURE SOULS.] Jose "Chille" DeCastro's jail call needs to be taken down and recanted, including the "petitioning" activity he claims his supporters should do - that is, mailing letters of support to Judge Zimmerman. First, Judge Zimmerman cannot simply "release" Chille. She no longer has jurisdiction and there's nothing in the code that allows a convict to be released simply because supporters flood the court with these so-called "petitions." I take a look at Nevada Revised Statutes ("NRS") 200.571, which makes it a misdemeanor on a first offense to "do any act which is intended to substantially harm the person...with respect to his or her physical or mental health or safety." This becomes a Class C felony if broadcasted over the internet. The question is this: did Chille break the law with this call? I think in some areas he did, but it is not my decision, nor am I am Nevada lawyer. This is just my opinion from a California perspective on a public issue as it has been broadcasted locally in Las Vegas, and Chille himself said he is going to broadcast his findings about Judge Zimmerman's alleged sentencing bias in the news media. Using the US mail to deliver these "petitions" could call in the United States Postal Inspection Service, the nation's first law enforcement agency, which Ben Franklin started to protect mail carriers. Because a judge is involved, and given the recent attack on a Nevada judge, and that the situation is volatile, I think Chille needs to step forward and disavow and call it off. This type of activities make it very difficult - if not impossible - for a lawyer to represent him. If he were my client, I would have told him to keep his head down, don't make waves, and get out as early as possible through good-time credits or any legal maneuvering he can do through his lawyers. What I discuss here is simply my perspective and does not have the force of law. Chille also stated in a video that an anti-terrorism unit contacted him in the jail. I have heard that the court is being subjected to call flooding and that a large amount of these so-called "petitions" have hit the court. I have also heard that Judge Zimmerman has taken issue with it, and Chille is wrong to call her out personally and to discuss her personal life. None of this is legal advice, and is my commenting on a public issue. This matter has been reported in local Vegas newspapers. I reserve all rights, including the protection afforded under California anti-SLAPP's statute.
