A grand jury convened and returned a true bill, indicting Kim Blandino on felony charges, superseding the jurisdiction of Justice of the Peace Kristal Bradford and bringing the matter before District Court Judge Mary Kay Holthus, who has granted Our Nevada Judges, Inc.'s request to provide comprehensive electronic coverage of the proceedings, the arraignment of which is scheduled for September 9, 2026. District Court Judge Jacqueline Bluth, who presided over the grand jury proceedings, ordered bail to remain set at $500,000.

Blandino responded three days later by challenging Judge Jones, citing his "desperate[] need[] [for] an uncompromised judge”. In a separate filing that day, Blandino sought to prevent District Court Judge Leavitt from hearing his challenge against Judge Jones.

Kim Blandino spent the hours before his December 2 hearing filing two more motions against the judges handling his case. By the end of the day, he could no longer represent himself or file documents on his own. In his first motion, filed at 8:34 a.m., Blandino again sought to disqualify District Judge Michelle Leavitt and every other district judge in Clark County. District Court Judge Tierra Jones summarily denied the motion. Blandino responded at 12:39 p.m.—approximately 21 minutes before the scheduled hearing—with another motion seeking to disqualify both Judges Leavitt and Jones.

Blandino Files Fifteenth Motion To Disqualify

Four days after declining to sign a negotiated guilty-plea agreement, Blandino filed what prosecutors counted as his 15th motion to disqualify a judge, citing his intent to call District Court Judge Michelle Leavitt as a witness. Blandino claimed to have made this decision after watching Kyle Rittenhouse testify in his own defense, concluding that he should follow suit because it would enable him to explain how his religious beliefs and investigations into alleged judicial corruption motivated the conduct underlying his criminal charges. Blandino reasoned that Judge Leavitt would be needed to corroborate portions of his testimony. Chief Deputy District Attorney Michael Dickerson moved to strike the filing and again asked the court to revoke Blandino’s self-representation. District Court Judge Tierra Jones summarily denied Blandino’s motion. The State also requested permission for Commission on Judicial Discipline Executive Director and General Counsel Paul Deyhle to testify remotely. Blandino objected, arguing that Deyhle needed to appear in person so his credibility and facial expressions could be evaluated.

Blandino Accuses District Court Judge Michelle Leavitt Of Having Alzheimer's

One day after District Judge Michelle Leavitt warned Kim Blandino that continued obstruction could cost him control of his defense, Blandino began building a new challenge against her. On September 20, Blandino filed a 352-page motion claiming that “hundreds of hours of legal and medical and psychological research” led him to suspect that Judge Leavitt might have early onset Alzheimer’s disease or another condition affecting her judgment. The allegations were Blandino’s own; the filing contained no medical diagnosis. Blandino asked Judge Leavitt to undergo a psychological evaluation and temporarily step away from the bench with pay—or resign. He suggested that medical, psychological, or “perhaps even spiritual treatment” might help her. Failing to pursue the issue, he wrote, “would be rejecting God’s gift to Kim.” District Court Judge Tierra Jones denied the motion on September 23, again relying upon First Judicial District Court Judge James E. Wilson Jr. prior ruling rejecting Blandino’s previous challenges. Six days later, Blandino refiled the motion, supplemented it, and moved to disqualify Judge Jones, and subsequently District Court Judge Nancy Allf. On October 14, Chief Judge Linda Marie Bell filed an order at 9 a.m. assigning Blandino’s challenge against Judge Allf to District Court Judge Cristina Silva. Eighteen minutes later, Judge Silva filed an eight-page order denying it. Judge Silva found no evidence that Blandino had properly served Judge Allf or her staff, and that his motion did not establish a factual or legal basis for questioning Judge Allf’s impartiality. She also denied his other judicial disqualification requests.

Another Judge, Another Disqualification Motion--Enter the Supreme Court

Every time a judge was assigned to resolve Kim Blandino’s disqualification motions, Blandino found another judge he believed should be removed. Blandino also moved to strike affidavits denying bias, arguing that they were filed late. The Supreme Court assigned Ninth Judicial District Court Judge Thomas Gregory to the matter. Judge Gregory, however, soon disqualified himself because he served as an alternate member of the Commission on Judicial Discipline, citing the potential involvement of Executive Director Paul Deyhle's a witness. First Judicial District Court Judge James E. Wilson Jr. took over the matter, upon which Blandino asked him to disclose possible conflicts and review the entire case record. On August 10, Judge Wilson denied Blandino’s third attempt to disqualify Judge Leavitt, finding that personal bias was not established. Judge Wilson also noted that Blandino had already filed three motions against Judge Leavitt and failed attempt to disqualify the entire district court bench.

These facts raise concern that Mr. Blandino has sought delay and to manipulate his court proceedings.

Dickerson relied on this finding in an August 13 supplement, citing Blandino's “plethora of meritless disqualification motions” to further support the use of self-representation to abuse the judicial process. Blandino treated Judge Wilson’s ruling as instructions for improving his next draft, filing on August 18, an amended motion with hundreds of pages of exhibits, again seeking to disqualify the entire Clark County district bench. The new filing again prevented Judge Leavitt from immediately addressing the State’s requests to jail Blandino, increase his supervision, or revoke his self-representation.

The Disqualification Campaign Paralyzes the Bench

The State wanted Kim Blandino returned to custody or placed under stricter supervision. It also wanted his right to represent himself revoked. Neither request could move forward while Blandino continued challenging the judges assigned to his case. By April 2021, Blandino had pending motions to disqualify District Judge Michelle Leavitt and Chief Judge Linda Marie Bell. On April 14, Chief Judge Bell noted that her department did not hear Blandino’s cases and transferred both challenges to District Court Judge Tierra Jones. Blandino responded that same day with another emergency filing demanding that the entire criminal case be assigned to a judge from outside the Eighth Judicial District Court. He argued that neither Judge Leavitt nor Judge Bell had answered his accusations within the required time. The filing also appealed to a higher authority.

Bell must know that God will hold her accountable for any continued wrongdoing.

Meanwhile, Judge Leavitt moved the State’s requests to April 29. Chief Deputy District Attorney Michael Dickerson still sought Blandino’s remand, tighter release conditions, and revocation of his self-representation. Before Judge Jones could decide the challenges against Judge Leavitt and Chief Judge Bell, Blandino moved to disqualify Judge Jones as well. His April 22 filing alleged that Judge Jones had an interest in the dispute and was among the judges he had asked the FBI to investigate. The document did not independently establish that the FBI had opened such an investigation. Judge Jones could not decide Blandino’s attempt to disqualify her, so she vacated the April 26 hearing and transferred that challenge to District Court Judge Nancy Allf.

Blandino Unleashes A Fusillade of Filings, Prosecutors Urge His Pretrial Detention

Kim Blandino spent the winter challenging District Court Judge Michelle Leavitt’s authority, fighting her finding that he had waived his speedy-trial rights—and alarming prosecutors with plans to visit areas near two judicial officials’ homes. On December 21, 2020, Blandino placed Judge Leavitt on notice that he had filed a petition with the U.S. Supreme Court about his unsuccessful attempts to disqualify her and other Clark County judges. He demanded that the criminal case be stayed while he pursued relief. On January 19, Blandino challenged Judge Leavitt’s finding that his refusal to follow courthouse health procedures amounted to a waiver of his speedy-trial rights. The dispute escalated in February. In a letter attached to a State filing, Blandino announced that he intended to visit the residential addresses of Judge pro tempore Michael Federico and Hearing Commissioner Shannon Nordstrom. He said he would examine the properties “from a discreet distance” while preparing anticipated lawsuits. Chief Deputy District Attorney Michael Dickerson responded by urging Judge Leavitt to remand Blandino to custody or place him on high-level electronic monitoring, arguing that the proposed visits could constitute intimidation, stalking or harassment. The prosecutor cited Blandino’s criminal history, the pending extortion charge and his “narcissistic opposition to authority.” Blandino replied that he was investigating potential civil claims, not threatening anyone, accusing prosecutors of retaliation and compared his existing supervision to being locked in a large basement. Before Judge Leavitt could decide the State’s request, Blandino moved to disqualify her again. His March 8 motion said he had submitted a criminal complaint against Judge Leavitt to the FBI and argued that she therefore had a personal interest in sending him back to jail. The filing did not establish that the FBI had opened an investigation. On March 15, Blandino filed a roughly 150-page motion seeking to disqualify Chief Judge Linda Marie Bell. Because Chief Judge Bell could become involved in deciding or assigning his challenge against Judge Leavitt, Blandino argued that she was also an interested party. Blandino warned that the delays were harming his defense, citing his age and "fading [] memory".

State Supplements Record With Blandino's Plastic Bag Mask

Prosecutors supplemented the record with an exhibit supporting the State's effort to end Kim Blandino’s self-representation: a photograph that the State said showed him attending a political event with a plastic bag over his head. Chief Deputy District Attorney Michael Dickerson filed the photograph on November 25 as part of the State’s supplement to its motion to revoke Blandino’s right to represent himself. Dickerson argued that the image undermined Blandino’s claim that his religious beliefs prevented him from wearing a face covering. According to the State’s filing, a hotel required Blandino to wear a mask before entering the event. Rather than leave, prosecutors alleged, Blandino obtained a plastic bag and wore it over his head. Dickerson also submitted months of Blandino’s emails to District Judge Michelle Leavitt’s staff.

Kim must speak as Kim’s Creator gives him to speak and write.

Dickerson characterized the communications as attempts to “threaten, insult and attempt to coerce” the court:

On November 30, Blandino filed an emergency notice and demand informing the court that he had sought federal habeas corpus relief challenging Judge Leavitt’s authority. Blandino also argued that appearing remotely would prevent him from observing Judge Leavitt’s facial expressions, demeanor, and other nonverbal signals. Without those cues, he said, he could not advocate effectively or determine when he was approaching contempt.

Prosecutors Challenge Blandino’s Right to Represent Himself

After Kim Blandino refused to wear a mask or appear remotely at the October 6 calendar call, prosecutors sought a different way to move the stalled criminal case forward: take away his right to represent himself. Chief Deputy District Attorney Michael Dickerson filed the State’s motion on November 6, asking District Court Judge Michelle Leavitt to revoke Blandino’s self-represented status and appoint defense attorney Bennair Bateman as counsel of record. The State argued that Blandino’s right to represent himself did not give him the right to obstruct the proceedings, ignore court rules, or prevent the case from reaching trial. Prosecutors described a continuing pattern of obstruction, citing specifically Blandino's delay of competency evaluations and repeated efforts to disqualify judges.

The right of self-representation is not a license to abuse the dignity of the courtroom

The motion also accused Blandino of contempt and violating the failure-to-appear statute. Blandino responded on November 16 with an emergency notice and demand opposing the State’s motion, insisting that he had not willfully refused to attend court, claiming that God had directed him not to wear a mask and not to appear through BlueJeans. The filing quickly moved beyond whether he should retain control of his defense. Blandino continued to insist that Leavitt was disqualified from presiding over his case, accusing her of criminally violating his rights, and demanding her resignation.


A Chaotic Calendar Call

District Court Judge Michelle Leavitt convened an October 6 calendar call. Deputy District Attorney Austin Beaumont appeared for the State, and Ben Bateman attended as Blandino’s standby counsel. Blandino did not enter the courtroom. A court marshal reported that Blandino had arrived outside the courthouse but refused to wear a mask and was therefore denied entry. Bateman told the court that Blandino claimed a religious exemption and possibly a medical exemption. Leavitt responded that Blandino could appear remotely through BlueJeans, as attorneys and other participants regularly did. Blandino also declined that option.

The Defendant does not get to dictate the rules.

Because Blandino refused both an in-person appearance under the courthouse’s mask requirements and a remote appearance, Beaumont asked the court to issue a bench warrant. Leavitt declined to issue one that day. She directed Bateman to warn Blandino that if he continued refusing to appear, the court would probably consider that remedy. Bateman also reported an unresolved discovery problem involving computer hard drives seized from Blandino. Beaumont agreed to relay the issue to Dickerson. Leavitt vacated the existing trial dates and reset the case for a November 24 calendar call and a November 30 jury trial. Blandino remained on bond and electronic monitoring.


Blandino Attacks the Judiciary and Refuses to Appear

Chief Judge Linda Marie Bell denied as moot Kim Blandino’s latest effort to reopen the judicial disqualification dispute, finding that he had offered no new evidence and could not retroactively remove her from a decision she had already made. The ruling, filed August 19, 2020, disposed of two emergency filings Blandino submitted eight days earlier. He had asked Bell to reconsider her August 3 refusal to disqualify Judge Michelle Leavitt, Senior Judge David Barker, and the entire Eighth Judicial District Court. As the case moved toward trial, Deputy District Attorney Michael Dickerson filed a supplemental witness list on September 22. The State identified Judge pro tempore Michael Federico, several law-enforcement officers, custodians of records, Executive Director Paul Deyhle, and LVMPD digital-forensics supervisor Zachary Johnson. Blandino responded with a 100-page demand asking the district court to recognize that he had sought a stay from the Court of Appeals. He argued that the district court could halt the prosecution itself rather than require the appellate courts to intervene. Blandino’s filing ranged well beyond the request for a stay. He disparaged Federico and criticized the appellate courts of refusing to consider his judicial-disqualification claims properly.

In some cases the court has waffled more than the Waffle House.

Removed From Court Over A Mask, Blandino Accuses Chief Judge Of Gaslighting

After refusing to wear a mask at a July 1 trial-readiness hearing, Kim Blandino filed a 394-page motion seeking the retroactive disqualification of Senior Judge David Barker. Blandino argued that he had not been notified in advance that Judge Barker would preside and should have been given an opportunity to challenge him before the hearing. Chief Judge Linda Marie Bell disposed of this motion, as well as all of Mr. Blandino's other pending motions to disqualify, with a summary denial. Specific to Judge Barker, Judge Bell concluded that the senior judge merely handled the July 1 trial-readiness conference and was never assigned to the case. Bell also found that Blandino failed to serve Judge Leavitt. Bell concluded in arguendo that Blandino had also failed to establish bias. Meanwhile, Deputy District Attorneys Melanie Marland and Michael Dickerson prepared to limit what Blandino could present to a jury. On July 20, the State filed a notice identifying its proposed expert witnesses by filing a motion in limine asking Judge Leavitt to prevent Blandino from presenting evidence involving unrelated judges, court employees, lawsuits, complaints, and prior judicial proceedings. The prosecutors argued that Blandino’s previous filings showed that he intended to turn the trial into a broader examination of the judiciary rather than focus on the two criminal charges before the jury.

Blandino Demands an Apology and Seeks to Remove Six Judges

Chief Judge Linda Marie Bell found Kim Blandino competent to stand trial on April 3, 2020, clearing the way for his extortion case to return to District Judge Michelle Leavitt’s Department 12. Chief Deputy District Attorney Glen O’Brien appeared for the State by video. Blandino continued to represent himself, with Ben Bateman appearing by video as standby counsel. Blandino returned from Lake’s Crossing after evaluators Dr. Henson and Dr. Dillinger concluded that he understood the criminal charges and could assist in his defense. Judge Bell opened the hearing by explaining that she wanted to ensure Blandino was released from custody that day. He had been detained only to complete the competency evaluation. “They found you competent, so I planned to have you released today and give you a date in Department 12,” Bell said. Blandino objected. He complained that he had not been able to consult with Bateman before the hearing and said District Court Judge Joe Hardy had prevented him from making a record during the January 24 proceeding. Blandino demanded a continuance and what he called a “full-blown competency hearing,” complete with subpoenas and witnesses. Bell pointed out the apparent contradiction in his position. “Sir, are you saying that you’re not competent?” she asked. “No, I’m not saying that,” Blandino replied. He nevertheless maintained that he had a right to retain his own evaluator and challenge the process without conceding that he was incompetent. Judge Bell rejected the request. Relying on the reports from Henson and Dillinger, she formally found Blandino competent to proceed and returned the criminal case to Department 12. “And I object,” Blandino responded. Judge Bell issued her competency findings on April 9, 2020. The order relied on evaluations by Drs. Henson and Dillinger, who found that Blandino could understand the criminal charges and assist in his defense. After Chief Judge Linda Marie Bell found Kim Blandino competent to stand trial, the case returned to District Court Judge Michelle Leavitt’s Department 12. The competency ruling did not end the dispute. It triggered a new round of filings in which Blandino demanded that Judge Bell reverse herself, publicly apologize, and disqualify the district attorney. He then sought to disqualify six judges—and ultimately every judge in the Eighth Judicial District—from presiding over the case. On May 4, Judge Leavitt reviewed the case in chambers and scheduled a jury trial for June 29. The court vacated a May 5 hearing and notified Deputy District Attorneys Michael Dickerson and Melanie Marland, along with Blandino, that no appearance was necessary. Two days later, Blandino filed a 28-page “Emergency Demand” asking Judge Bell to vacate the competency finding retroactively. Blandino relied on an affidavit Judge Bell had signed in December 2019 after he moved to disqualify her. In that affidavit, Judge Bell wrote, “I am not hearing any of Mr. Blandino’s further competency proceedings.” Because Judge Bell later presided over the April 3 hearing, Blandino argued that she had violated her sworn statement. He presented the chief judge with two possible explanations: either she made a mistake by hearing the case, or she committed perjury. “Since perjury is a crime, the presumption must be that [Judge] Bell made a mistake,” Blandino wrote. He demanded that Judge Bell vacate the competency finding, take corrective action, and provide him with “a formal apology in public orally and/or written.” He also accused the district attorney of lying during the April 3 hearing and demanded that the prosecutor be disqualified. Blandino wrote that he prepared the demand under “the most extreme circumstances” because of the COVID-19 shutdown. He accused “megalomaniacal persons in authority” of using the crisis to eliminate individual liberty and referred to the governor as “power mad.” If the motion was denied, Blandino requested a stay so he could pursue an emergency petition with the Supreme Court. The motion revisited nearly every stage of the competency proceedings. Blandino accused the judges of presiding without proper assignments, acting while disqualification requests remained unresolved, and denying him an opportunity to create a complete record. He wrote that he and standby counsel Ben Bateman were “absolutely shocked” when Bell appeared at the April 3 hearing after stating in her affidavit that she would not preside over any further competency proceedings. Separately, Judge Leavitt granted Our Nevada Judges, Inc.'s request to provide comprehensive electronic coverage of the proceedings.

Blandino Remains Detained At Locked Psychiatric Facility

District Judge Joe Hardy ordered Kim Blandino transported to a locked psychiatric facility for further competency evaluation and treatment following a hearing that lasted approximately one minute on January 24, 2020. Deputy District Attorney Michael Dickerson appeared for the State. Blandino represented himself, with Ben Bateman serving as standby counsel. Blandino entered the courtroom in restraints and immediately asked Hardy to remove his handcuffs so he could reach his paperwork at the counsel table. “I’ve got standby counsel next to me,” Blandino said. “LaMon [sic] Walker could pick me up and crush me with one hand if anything happened. I guarantee it, nothing’s going to happen.” Before ruling on that request, Hardy began explaining the status of the competency evaluations. Drs. Sunshine Collins and Daniel Sussman had been unable to determine whether Blandino was competent because, according to the court, he refused to participate in their examinations. Blandino interrupted and asked the judge to rule on his request concerning the restraints. Hardy continued with his ruling. Because the doctors could not reach a competency determination, the judge ordered Blandino remanded to the custody of the Clark County sheriff for transportation and further observation and treatment. Blandino protested that he was not being allowed to respond. “Do I need—I don’t get to make any kind of record here, Judge?” he asked. “This is outrageous. I’ve got a right to make a record.” The hearing ended immediately afterward. A written commitment order filed January 29 provided additional details. The court found that Blandino required further evaluation and treatment and that commitment was necessary to determine whether he could be restored to competency. The order directed that he be transported to a secure facility operated by the Nevada Division of Public and Behavioral Health. The order also suspended the criminal proceedings until mental health officials determined that Blandino could understand the charges and assist in his defense. He was to remain in custody until the court ordered his release or returned him for trial.

Kim Blandino Remanded To Locked Psychiatric Facility For Completion of Competency Evaluation

District Judge Cristina Silva ordered Kim Blandino remanded into custody on January 3, 2020, finding that he had failed to complete competency evaluations despite repeated court orders and opportunities to do so. Deputy District Attorneys Michael Dickerson and Melanie Marland were listed as appearing for the State. Blandino represented himself, with Ben Bateman serving as standby counsel. Denise Baker of the specialty courts was also present. Dickerson told the court this was the eighth time the competency matter had appeared on the calendar and that Blandino still had not completed the required evaluations. He accused Blandino of refusing appointment dates offered by the evaluators and argued that placing him in custody was the only practical way to complete the process. Blandino immediately disputed the prosecutor’s account. “That’s a lie,” he said. Judge Silva repeatedly instructed Blandino to stop interrupting and assured him that he would have an opportunity to respond. Blandino continued objecting, accusing Dickerson of making misrepresentations and questioning the authority of the judges involved in the case. The January 3 proceeding became increasingly contentious. Blandino repeatedly interrupted Judge Silva and Dickerson, accused the prosecutor of lying and argued that an unresolved disqualification motion prevented Silva from taking any action. “You can’t sit on the bench, Judge,” Blandino told her. Silva directed him to lower his voice. Judge Silva ultimately found that Blandino had attempted to comply with the December 6 order but had completed only half of what was required. He did not attend the December 11 appointment, offered no explanation for missing it, and did not arrange an examination with the second doctor. The judge granted the State’s request and ordered Blandino taken into custody so the evaluations could be completed. “Ha, ha, yeah,” Blandino responded as Judge Silva announced the ruling. When told that the evaluations would proceed in the ordinary course, Blandino objected that the process could take three months and called the decision “outrageous.” Dickerson said court staff expected to complete the examinations in about three weeks. Blandino was removed from the courtroom while the court finished making its findings.

Chief Deputy District Attorney Michael Dickerson appeared for the State. Blandino represented himself, with Ben Bateman serving as standby counsel. Denise Baker of the specialty courts was also present. The hearing was brief, but Blandino repeatedly attempted to expand it. As he approached, Blandino asked whether a 94-year-old World War II veteran who accompanied him could enter the courtroom to watch. Judge Bell responded that the proceeding would take only a moment. Judge Bell continued the competency matter for two weeks instead of involving another judge while the disqualification dispute remained unresolved. Blandino objected and repeatedly insisted:

I demand to make a record. There’s been a fraudulent document and a crime committed in filing this motion to disqualify.

He argued that he needed to place the allegation on the record so he would not face possible criminal charges himself. Dickerson responded that the allegation had nothing to do with the competency hearing.

Sounds like Mr. Blandino should go file a police report at the police department.

The prosecutor added that the two-week delay gave Blandino more time to complete the psychiatric evaluations Judge Marquis ordered. If he failed to do so, Dickerson warned, the State would seek to have him remanded into custody. Judge Bell refused to hear further argument and continued the matter.

Chief Deputy District Attorney Glen O’Brien appeared for the State, and Ben Bateman attended as Kim Blandino’s standby counsel. Blandino described his house arrest as “punitive” custody. He then argued that Judge Bell could not preside because he had an unresolved motion seeking to disqualify her in another case. Judge Bell explained that she was not deciding Blandino’s competency that day because evaluations were still incomplete, and the hearing was meant to move the process forward. She encouraged Blandino to cooperate with the doctors and warned that if he refused, another judge could place him in custody so the evaluations could be completed. Blandino responded that he had never received a written order requiring him to participate. He also said a vexatious litigant order prevented him from filing an opposition to the competency referral. When Judge Bell explained that refusing the evaluations could result in his detention, Blandino called the warning a “threat.” Judge Bell entered a written order following the December 3 competency hearing, directing Blandino to cooperate with an examination by two mental-health professionals, warning that failure to participate could result in his temporary detention until the court resolved the competency question. District Judge Linda Marquis ordered Kim Blandino to schedule two competency evaluations within seven days but declined the State’s request to immediately remand him to custody following a contentious December 6, 2019 hearing. Deputy District Attorneys Melanie Marland and Michael Dickerson appeared for the State. Blandino represented himself, with Ben Bateman serving as standby counsel. The hearing began with Blandino arguing that the competency order was legally insufficient because it did not clearly require examinations by two mental-health professionals. He also focused on misspellings in its title, questioning what a “phsychiatrist” or “psuchologist” was. Blandino also attempted to submit an oral motion seeking to disqualify Judges Michelle Leavitt, Linda Bell and Marquis, which Judge Bell summarily denied, finding no basis for doing so. The hearing then shifted to Blandino’s failure to complete the court-ordered evaluations. Dickerson told the court that Blandino had not cooperated with the evaluation process despite repeated opportunities. The prosecutor asked that Blandino be returned to custody so the examinations could be completed. The State also raised Blandino’s contact with former Justice of the Peace pro tempore Telia Williams, who had presided over proceedings connected to the allegations underlying the criminal case. Dickerson said Blandino went to Williams’s private law office, delivered documents and later called the office seeking to speak with her. According to the prosecutor, Williams considered the documents threatening and was concerned for her safety. Dickerson argued that the contact violated Blandino’s release conditions and was particularly troubling because Williams’s private office did not have the security available inside a courthouse. Blandino denied doing anything improper. He repeatedly insisted that the documents were not a “letter” but “service of process.” He said his house-arrest officer had permitted him to visit the office and called the State’s description of the documents “hogwash.” When Judge Marquis referred to the complaining witness as the victim, Blandino immediately corrected her:

I’m sorry, Judge, alleged victim[.] I’m presumed innocent.

Judge Marquis accepted the correction and apologized. Blandino nevertheless argued that her choice of words demonstrated bias, accused her of acting as a “sub-prosecutor,” and asked her to recuse herself. Throughout the hearing, Judge Marquis repeatedly instructed Blandino not to interrupt Dickerson and assured him that he would have an opportunity to respond. Blandino accused the prosecutor of lying and violating his duty of candor. At one point, Bateman declined to make an argument, explaining that Blandino had made clear that Bateman’s role was limited to serving as standby counsel. Judge Marquis ultimately denied the State’s request to take Blandino into custody. She instead gave him another opportunity to complete the competency evaluations. The resulting order required Blandino to schedule appointments with Dr. Kapel and Dr. Slagle within seven days. It also prohibited him from contacting Williams, privately or professionally, outside recorded courtroom proceedings. Blandino was further prohibited from contacting judges at their homes or private offices and could not serve a judge with court papers without first obtaining permission from a district court judge.

From a $25 Demand to Competency Court: How Kim Blandino's Extortion Case Began

According to an indictment, between April 8 and May 21, 2019, Kim Blandino told Municipal Court Judge Pro Tem Michael Federico that he must pay $25, enroll in a program Blandino called “Ethics, Fairness and Security in Your Courtroom and Community,” or contribute $500 to the Clark County Law Library. Prosecutors drew the line at criminal extortion when Blandino threatened to report Federico to the Commission on Judicial Discipline and accuse him of a federal civil-rights crime if he refused to comply. Blandino was also charged with impersonation for allegedly telling Federico and Las Vegas Marshal Peter Marwitz that he was an unpaid or volunteer investigator for the Commission on Judicial Discipline. Deputy District Attorney Michael Dickerson signed the indictment, and the case was assigned to District Court Judge Michelle Leavitt in Department 12. Blandino represented himself. At his July 23 arraignment, he sought to disqualify Judge Leavitt. He asked for a judge from outside the Eighth Judicial District, citing investigations he said he was conducting into members of the local judiciary. Judge Leavitt allowed him to file a motion challenging her participation, postponed the arraignment, and left his existing house-arrest conditions in place. The court then considered whether Blandino should undergo a competency evaluation. The State’s motion had mistakenly been titled as a request to “remand” him, but Deputy District Attorney Melanie Marland clarified that prosecutors were asking only that he be “referred” to competency court. After reviewing the record and Blandino’s filings, Leavitt made the referral “out of an abundance of caution.” Blandino objected.
