Nika Nikoubin accused her defense attorney, Damian Sheets, of a substantial failure to fulfill his obligations. Mr. Sheets responded with a motion to withdraw, arguing that representation had become unreasonably difficult.

District Court Judge Jessica Peterson issued a bench warrant for the arrest of Nika Nikoubin, citing an alleged violation of the conditions of the probation. Defense attorney Damian Sheets responded with a motion to quash, arguing she faced charges in Texas where she had been deemed incompetent to stand trial and was receiving treatment.

Defense Attorney Alanna Bondy, on behalf of Nika Nikoubin, requested an additional $4,600 in public funding to cover the costs of retaining psychologist Dr. Bruce Frumkin, arguing his expert testimony is necessary for mitigation purposes at sentencing. Ms. Bondy also submitted a sentencing memorandum discussing Ms. Nikoubin's mental health history and treatment and advanced a position that she was in a "full-blown psychotic state" at the time of the offense.

The State filed briefing opposing Nika Nikoubin's efforts to dismiss the indictment, characterizing the grand jury foreperson's reference to battery as a minor recitation error, arguing that the two neck wounds provided sufficient probable cause to charge two separate batteries and that evidence that Ms. Nikoubin isolated and blindfolded the victim before stabbing him twice, supported an inference of an intent to kill. Ms. Nikoubin remains out on bail with high-level electronic monitoring. The State later amended the indictment, replacing the attempted-murder and battery charges with two counts of false imprisonment with use of a deadly weapon after Ms. Nikoubin entered into an agreement to plead guilty.

Nika Nikoubin pleaded not guilty during an arraignment before District Judge Carli Kierny and waived her right to a speedy trial. The Court scheduled a jury trial for July 31. Defense Attorney Anthony Sgro filed a petition for writ of habeas corpus urging dismissal of the indictment alleging lack of sufficient evidence supporting attempted murder because Ms. Nikoubin was accused of intending to hurt the victim, which lacks the requisite malice.

A Clark County grand jury indicted Nika Nikoubin on attempted murder with use of a deadly weapon and two counts of battery with use of a deadly weapon, alleging she stabbed Daniel Trevino because of his nationality. Chief Judge Jerry Wiese declined to alter the $60K bail imposed by Henderson Justice Court and ordered high-level electronic monitoring and no contact with Mr. Trevino. District Court Judge Carli Kierny granted Our Nevada Judges, Inc.'s request to provide comprehensive electronic coverage the proceedings.
